I've Been Served

Back off, I'll take you on...

He came knocking again...at 10:00 p.m.!  My daughter called to say she was afraid to come home because he was lurking outside the door.  This made me so angry, I threw open the door and started yelling at him.  He took a step back, his eyes wide.  

He did have papers to serve.  One of my creditors is suing me in small claims court.  While there is no garnishment of wages in Texas, they might be able to attach (is that the right word?) my bank account.  I guess I'll be visiting a lawyer next week.  Maybe a deal can be made out of court.

Sounds really dangerous especially if your daughter is alone at home. Hope there is someone you could confide in to help out Jen.

If he's an employee of a process service company he needs to be reported to them -- he had no business frightening your daughter even passively. And if he owns his own process service company or is employed by the courts, he needs to be reported to them or his licensing agency. His behavior was flatly reprehensible. I've worked for attorneys and the process servers we used were always pretty up front with folks. Just knock on the door, if there's no answer leave a card with a message. When the person calls, simply let them know a suit has been filed against them and you are to serve them with the summons.

Most folks just suck it up and arrange for the process server to come over at a convenient time... although that said, most of our cases were family law and tended to be mutual, so there wasn't so much of a blindside.
